Can a Private Process Server Serve Papers on Any Day of the Week?

Sometimes getting papers served in your legal matter can be difficult. If the person needing to be served has a very hectic schedule during the week, it may be difficult to get them served during normal business hours. But can the process server act outside of this limited time frame? The simple answer is yes. Here is what you need to know.

Serving Papers on Weekends

It is completely legal for a private process server to serve papers on any day of the week, including Saturday and Sunday. Most often private process servers will attempt service on any day of the week other than Sunday. However, if the individual can only be found at home on a Sunday afternoon, the process server can serve the papers at that time if they wish. Papers can also be served in the evenings, although not late at night.

Serving Papers on Holidays

Holiday schedules do not have any impact on private process servers. While it is never pleasant to interrupt someone’s holiday with service of process, it is sometimes necessary. Most process servers will try not to work holidays, but if the situation warrants it and the individual has been difficult to track down at other times, they may be willing to serve papers on the holiday. National holidays such as President’s Day and the Fourth of July also do not impact process servers.
